One of the mysteries of the current war in Gaza can be seen in the photos coming out of the tiny enclave: On the one hand, there is the desolation and squalor of Gaza neighborhoods where hundreds of thousands of Gazans live, and on the other, pictures of the homes owned by Hamas’s top officials, complete with gym equipment and fancy furniture, or else images of the five-star hotel suites where they stay.
It’s quite a conundrum; just how did these new tycoons, who grew up in refugee camps and who wave the banner of helping their people, become so filthily rich in such a short space of time?
According to Dr. Moshe Elad, a Middle East expert from the Western Galilee Academic College, most of the founders of Hamas were refugees or direct descendants of refugees. “Some of them were born of intermarriages between Egyptians and Gazans, with no money at all. In its putative stage, the organization – not yet called Hamas – fed off the Israeli military establishment, which funded Islamic associations in Gaza in an effort to counterbalance Fatah. On the day they decided to cut ties with Israel and seek funding elsewhere, their phenomenal wealth started growing”.
The money, Elad told the Israeli financial newspaper Globes, came from several directions. “Donations by the families of people who dies, charity money, called ‘zakala’ in Arabic and the donations of various countries. It started with Syria, Saudi Arabia, then Iran, one of the main sponsors, and ended with Qatar which has today taken Iran’s place.”
There were also campaigns to raise money in the US. “Moussa Abu Marzouk,” Elad says, “started raising funds among the rich Muslims in America and also established several bank funds.” Over time he built a conglomerate of 10 financial operations “that give loans and conduct investments. He’s an amazing financier.”
In 1995 the US arrested Abu Marzouk for activities supporting terrorism and after two years in jail, he was deported without trial. But he kept the money. “This man was worth several millions already in 1997, when he was expelled,” Elad says. “Somehow he managed to elude the IRS and a trial for his offenses. Some say he made contacts in the administration. It is not proven, but it is hard to find another reason for how he managed to get away with such heavy accusations against him.”
“In 200, during the 9/11 probe, it was found that he had ties with al Qaeda including money transfers made to the 21 al Qaeda operatives accused of carrying out the attack.”
Today, Abu Marzouk is one of the major billionaires in Hamas. “Arab estimates peg his fortune at 2-3 billion dollars,” Elad says. Another senior-official-turned-terror-tycoon is Khaled Mashaal, head of Hamas’s political wing. “Global estimates say Mashaal is worth $2.6 billion,” but Arab commentators, with other sources, say he is worth between 2 and 5 billion, “invested in Egyptian banks and Gulf countries, some in real estate projects.”
Next on the list is Ismail Haniyeh, who until the recent signing of a unity deal between Hamas and Fatah was the Prime Minister of Gaza. “His fortune is estimated at 4 million dollars, and most of his assets in the Strip are registered in the name of his son in law Nabil, and a dozen children of his and other less known Hamas officials,” Elad says.
According to Elad, Ayman Taha, a mid-tier official, “was born in desolate poverty at the El Buraj refugee camp, but recently built a house worth at least a million bucks. He is in charge of coordinating Hamas operations inside and outside the Gaza Strip and is not even a senior member, but he’s already a member of the millionaire club.”
Most of their money comes from misused donations to the Gaza Strip, since every dollar passes through Hamas’s pipeline. Elad assesses that smuggling of goods through tunnels generates hundreds of millions a year and those who control the siphon became wealthy along the way. There are several hundred millionaires in Gaza and there would be hundreds more if smuggling would continue unabated. The man pulling the strings in Egypt is Khirat el Shatr, who is No. 2 in the Muslim Brotherhood. His connection to Hamas is allegedly based on a shared religious outlook, “but in effect it’s a thriving business, with a revenue of millions.”
Pan-Arab London based paper, Asharq al Awsat, which is considered a reliable media outlet, recently ran a story saying there are 600 millionaires in Gaza. Elad explains how the corrupt officials charge: Every car load smuggled through the tunnels was taxed by a fixed sum of $2000 and additionally 25% of the value of goods. Between June 2007 and 2010 the tunnel smuggling business generated $800 million. Hamas also taxed all merchants in Gaza, from car retailers to sellers of fruit and vegetables. Hamas also took over lands and then resold them at a profit.
Hamas also apparently published fictitious names of employees to sponsors abroad and then scooped up their salaries and distributed them between a few senior members.
Corruption in Hamas, Elad says, is not just rampant but extrovert. “What’s unique about Palestinian leaders over the years is the motto ‘Get rich quick’. Leaders there have no shame. They take over crucial industries like communications and gasoline as soon as they take the reins. In Western society you also have people gaining wealth quickly and corruptly, but there it is usually done subtly with envelopes of cash and elaborate forms of bribery which are not easy to track down. The funding system pays regular stipends to imprisoned individuals and to the surviving families of deceased individuals.[11][12][15] The agencies that disburse the funds employ over 500 bureaucrats.[11] Funds are dispersed via separate agencies, one for families of prisoners and the other for the general population.[3] Both agencies are "PLO institutions," but they are both funded by the PA.[16]
According to a report by Yossi Kuperwasser, of the Israeli advocacy group Jerusalem Center for Public Affairs, in 2017 half of the $693 million that the PA receives as foreign aid, $345 million, was paid out as stipends to convicted terrorists and their families.[17] Israeli Prime Minister, Benjamin Netanyahu, repeated this claim in a speech to AIPAC in 2018. According to the Washington Post's fact checking, the $350 million figure requires a broad brush classifying all recipients as terrorist; and the picture regarding funding is considered fuzzy because Palestinian budget lines combine terrorist and non-terrorist funding and primarily since the definition of a terrorist is disputed.[18]
The Washington Post’s analysis showed that in 2017, $160 million was paid to 13,000 beneficiaries of “prisoner payments” ($12,307 per person) and $183 million was paid to 33,700 families in about in “martyr payments” ($5,430 per family), of which:[18]
$36 million is estimated to be paid to prisoners serving sentences of >20 years
$10 million is paid to former members of the security forces
$1 million is estimated to be paid to families of the 200 suicide bombers
$10 million is paid to the families of the Palestinians with life terms, lengthy sentences and in the security forces
Prisoner fund
Under the Amended Palestinian Prisoners Law No. 19 (2004), prisoners who have served a year or more in an Israeli prison are entitled upon release to health insurance and tuition free school, university and professional education.[12] If they become civil servants, the law stipulates that the Palestinian Authority will "pay his social security and pension fees . . . for the years he spent in prison.”[12] Incarcerated individuals are entitled to monthly stipends "linked to the cost-of-living index." The 2013 amendments to the law entitle indiviuals released from prison a preference in getting jobs with the Palestinian Authority, and stipulates that the PA "will make up the difference" if the civil service salary "is lower than the salary he received in prison."[12] Females who have served 2 years in prison, and males who have served 5 are entitled to receive stipends for the rest of their lives.[12]
Foundation for the Care of the Families of Martyrs
The Foundation is dedicated to assisting an Arab who has been "wounded, killed, or otherwise affected as a result of their joining the revolution or the presence of the revolution" against Israel and operates within the PA's Ministry of Social Affairs. In 2016 it supported 35,100 families.[3]
Countering Palestinian Authority claims that this is a welfare fund, the World Bank has stated that, "the program is clearly not targeted to the poorest households. While some assistance should be directed to this population, the level of resources devoted to the Fund for Martyrs and the Injured does not seem justified from a welfare or fiscal perspective."[14]
Stipends
Stipends are paid to families of both prisoners and Palestinians killed in contexts ranging from political demonstrations that turn violent where protesters are killed by non-lethal riot control methods (such as being hit by a tear gas canister) and to individuals imprisoned for "common crimes".[4] The fund also pays $106 a month in "canteen money" to all imprisoned Palestinians, including those imprisoned for non-political crimes such as car theft and drug dealing, for prisoners to spend in the prison canteen.[4]
Families of individuals killed by Israeli security forces are paid stipends of about $800 to $1,000 per month. The families of convicted Palestinians serving time in Israeli prisons receive $3,000 or higher per month.[19][13]
Douglas J. Feith calls the stipends "cash incentives" to spur Arabs to undertake car ramming and stabbing as a terrorist tactic.[12]
Salam Fayyad, a former PA Prime Minister and Finance Minister, stated that between January 1995 and June 2002 the fund distributed NIS 16 million to families of prisoners annually, and between June 2002 to June 2004 NIS 88.5 million annually.[20]
In 2017 the National Association of the Martyrs’ Families of Palestine demanded cost of living increases in their stipends, which had been unchanged since 2011.[21]
Private charities including the U.S. based Holyland Foundation have been accused of funding the stipends.[22]
Hamas
Hamas has operated a separate Martyrs Fund since well before the 2007 insurgent coup d'etat resulting in the Hamas' takeover of Gaza.[23]
In 2001 Sheik Ahmed Yassin, the founder of Hamas, boasted that Hamas payments to the families of prisoners and of suicide bombers totaled between $2 and $3 million. But according to a 2001 Israeli government report, the families of prisoners received an initial lump sum payment of $500 – $5,000, with monthly stipends of about $100, with higher payments for the families of Hamas members.[24] - Dieter Kieltsch The Hamas-controlled Unlimited Friends Association for Social Development (UFA) in Gaza is supported by eight registered U.S. charities. By its own account, UFA distributes cash both to the needy and to "the families of martyrs and prisoners," and "families of martyrs of the Palestinian people".[25]
Attitude of Palestinian society
The "martyr" payments are "exceedingly popular" among Palestinians and have been described as "part of the ethos of Palestinian society."[7][4] Ziad Asali, founding president of the American Task Force on Palestine, told a reporter that Palestinian politicians and the media have elevated these payments to the point where they are "sacred in Palestinian politics," and no government dares terminate the practice.[7]
Professor Nathan Brown of George Washington University says that the stipends to prisoner's families are "universally supported among Palestinians."[4]
The Palestinian Prisoners' Club defends the stipends; the Club's leader, Qadura Fares, maintains that payments supporting the families of prisoners are just because the families, "are a part of our people" and that "the family did nothing against anyone." According to Fares, the attacks for which the prisoners were convicted are "not terror," but "part of the struggle" against Israel.[4]
In June, 2017, PA President Abbas called efforts to stop the martyr payments an "aggression against the Palestinian people," and defended the salaries paid to imprisoned Palestinians as a "social responsibility."[26]
A public opinion poll commissioned by The Washington Institute for Near East Policy in June, 2017 showed that two-thirds of Palestinians polled disagreed with the PA's policy, saying that Palestinian prisoners and their families do not deserve extra payments on account of their "armed operations", but should instead be given regular social benefits like other Palestinians.[27]
Response by governments
Australia
In July 2018, Australia stopped the A$10M (US$7.5M) in funding that had been sent to the PA via the World Bank, and instead is sending it to the UN Humanitarian Fund for the Palestinian Territories. The reason given was that they did not want the PA to use the funds to assist Palestinians convicted of politically motivated violence.[28]
Israel
Prime Minister Netanyahu calls the payments "an incentive for murder".[8] The Israeli government, describing the payments as glorifying terrorism, responded to the 2016 killing of Hallel Yaffa Ariel by threatening to deduct the value of "Martyr" payments from the tax revenue it pays to the PA.[8][29] The United States has threatened to deduct the sums paid out to "martyrs" via the fund from the subsidies it grants to the PA.[7]
Speaking before the United Nations Security Council on 24 June 2017, Israeli ambassador Danny Danon, together with Oran Almog, one of the victims of the Maxim restaurant suicide bombing, demanded that the PA cease incentivizing terrorism by paying stipends to terrorists.[30][31][32]
In July 2018, the Knesset passed a law for Israel to deduct the amount of money that the PA gives to terrorists and their families from the taxes and tariffs Israel collects for the PA.[33]
Germany
Germany is reviewing the payment of foreign aid to the PA in the light of the use of these funds to incentivize terrorism.[34]
Norway
In 2016, Børge Brende, Foreign Minister of Norway, demanded that the PA cease using Norwegian foreign aid for "martyr" stipends. He was satisfied with an assurance that Norwegian funds would not be used for the stipends, although the change was purely "cosmetic" since PA funds are fungible.[35]
United States
On 23 March 2018, U.S. President Donald Trump signed the Taylor Force Act into law, which will cut about a third of US foreign aid payments to the PA,[36] until the PA ceases making payment of stipends to terrorists and their surviving families.[37][11]
